Cybercrime Law and the Council of Europe’s Cybercrime Treaty

Cybercime grabbed headlines last year with the enactment of the Cybercrime Prevention Act (R.A. 10175) and the numerous petitions which questioned its Constitutionality. But cybercrime persists as a problem that requires a policy response. In this session, DOJ Assistant Secretary Geronino L. Sy will speak about recent moves to amend the law even as the Supreme Court deliberates on the contested statute. He will also discuss the Philippines’ efforts at acceding to the Council of Europe’s Cybercrime Treaty which calls for international cooperation to combat cybercrime.

Cybercrimes and Forensics

This technical session will discuss the investigation of cybercrimes and tools used to undertake the analysis of a cybercrime scene. Case studies will be used to provide context and deepen understanding of the technology as it relates to the newly defined cybercrimes.

Data Privacy 101

Privacy has many dimensions under Philippine law – the latest of which can be found in the Data Privacy Act of 2012 (R.A. 10173). Under R. A. 10173, the integrity and security of personal data in the private and public sectors are protected by the State. The enactment of R.A. 10173 also brought the Philippines at par with international standards on data protection. In this session, the basics of R.A. 10173 shall be discussed in the context of the Philippine law and jurisprudence on privacy as well as international perspectives that contributed to its formulation.

The Data Privacy Act (R.A. 10173) is a complex statute with a myriad of compliance requirements ranging from data formats to security obligations for systems that handle personal information. This session intends to present a framework for compliance consisting of privacy policies, consent forms, governance policies, and technical requirements. For those building I.T. systems or governance procedures, the integration of legal compliance in the design is essential to avoid civil liability and potential imprisonment. The law also imposes unique compliance requirements for government systems. In both the public and private sector, changes in many – if not all – aspects of an organization are needed to avoid violating the law. Only a concerted effort among those involved in management, legal, governance, and I.T. can ensure full compliance.

JJ Disini
JJ Disini is a graduate of Harvard Law School and is a technology law expert. He was actively involved in the lobbying efforts for the passage of the eCommerce Act (Republic Act No. 8792). He drafted the eCommerce Act’s Implementing Rules and Regulations under the supervision and control of an inter-agency task force committee co-chaired by the Department of Trade & Industry, Department of Budget and Management of the Bangko Sentral ng Pilipinas.

JJ is a petitioner in one of the cases filed before the Supreme Court questioning the Constitutionality of the Cybercrime Prevention Act. He is one of five (5) legal counsel selected to argue the Petitioners’ case before the Supreme Court on January 15, 2013.

After graduating (Dean’s Medal) from the UP College of Law and placing 7th in the Bar Examinations, JJ has been continuously practicing law since 1994. In 2004, he obtained a Degree in Masters of Law (LLM) from Harvard Law School. His areas of expertise are in Technology Law, Corporate, Litigation and Intellectual Property. He has represented local and foreign clients in, among others, corporate, project finance, securities, foreign investment, technology, telecommunications, Internet and eCommerce projects. JJ is also an Associate Professor in the UP College of Law.

Janice Crisostomo-Villanueva

Janice Crisostomo-Villanueva, active mom to three kids, is one of the most active parenting advocates and mom entrepreneurs in the Philippines. She is founder of the Philippines’ go-to portal of resources for moms, called Mommy Mundo.

Her first business venture as a mompreneur was Mommy Matters Inc., a pioneering nursingwear brand in the country, and distributor of innovative mom and baby products which she set up together with her cousin. She is also publisher of the ultimate directory for moms in the Philippines, Mommy Pages, as well as Urban Mom, a lifestyle mini-magazine distributed for free to moms all over the metro. Together with her husband and their creative team, Janice runs a flourishing events management and publishing company, Creative Juice. Her latest venture is as co-founder of the successful food and lifestyle market, Mercato Centrale @ BGC.

Janice has also successfully combined her advocacies for breastfeeding, healthy pregnancy, active parenting and mompreneurship with her passion for well-planned events. Together with friend and childbirth educator Rome Kanapi, she and her team have been staging successful, much-awaited events namely Expo Mom, Mommy Milkshake Marathon, Moms on the Floor, Expo Dad and Expo Kid.

Janice is also a former “real mom” columnist of H.I.P.P. Magazine, a publication by Sesame Seed Creatives, and is currently a columnist of Working Mom Magazine published by ABS CBN Pubishing Group, where she writes a column dedicated to mompreneurship.

Hon. Geronimo L. Sy

Geronimo L. Sy
Asec. Sy is a career public servant having served at the Department of Justice for almost 15 years. At the DOJ, he heads the Office of Cybercrime and has organized various local and international fora on cybercrime and criminal justice. He likewise directed a Criminal Code Committee that, consistent with Pres. Aquino’s call for simiplified law, codified all criminal laws including the Revised Penal Code. He sits at the Supreme Court’s Subcommittee on Electronic Commerce and was active in the formulation of the Rules on Electronic Commerce. In 2011, Asec. Sy was tasked to head the DOJ’s Office for Competition and in that capacity, he has spearheaded efforts to combat anti-trust and monopolies in the country. Asec. Sy is a graduate of Ateneo De Manila where he earned a B.S. in Management Engineering and a Juris Doctor in Law. He also holds an M.A. in Public Management from the University of the Philippines.

Joey I. Narciso finished Bachelor of Science in Civil Engineering (BSCE) at the Bulacan State Univesity in 1998 where he became a three-time Dean’s Lister. He thereafter took some units of law at the Adamson University in Manila where he also became a Dean’s Lister. He entered the government service in 2003 after he successfully finished the 40th NBI Agents’ / 13th Special Investigators’ Basic Training Course at the NBI Academy.

Mr. Narciso developed different skills and gained technical knowledge in computer technology through the several trainings he received, from open sources available and from the investigations he conducted as a cybercrime investigator. He now possesses knowledge in the most recent cyber threats, computer forensics with Encase, programming languages that include Turbo Pascal, Visual Basic, Java Programming and HTML.

He has also been an active member of the team that was created by the Department of Justice (DOJ) that educates the DOJ Prosecutors in cybercrimes. He was also tapped by the Philippine Judicial Academy (PHILJA) in its effort to train Judges on properly handling cybercrime cases. Mr. Narciso has also conducted several lectures, trainings and workshops on cybercrimes, cybersecurity and computer forensics.
